Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Meridian Trace website and application at meridiantrace.com (the "Service"). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Please read these Terms carefully. They affect your legal rights.

1. The Service

Meridian Trace is a medical device regulatory intelligence platform. The Service indexes publicly available medical device registration data from regulatory authorities across 18 global markets — including Indonesia (BPOM), Singapore (HSA), Malaysia (MDA), Thailand (FDA-TH), Japan (PMDA), South Korea (MFDS), China (NMPA), Vietnam (DAV), United States (FDA), European Union (EUDAMED), Canada (Health Canada), Brazil (ANVISA), India (CDSCO), Australia (TGA), Taiwan (TFDA), Hong Kong (MDCO), Philippines (FDA-PH), and UAE (MOHAP/EDE) — and provides normalized, searchable access to that data alongside enrichment layers developed by Meridian Trace.

2. Authorized use

You may use the Service for your own professional research, regulatory intelligence, and business decision-making purposes. You may use exported data (where export is available on your subscription tier) in your internal business processes, reports, and client deliverables, provided you comply with the restrictions below.

2a. API and MCP access

This section applies if you access the Service programmatically — through our REST API, our Model Context Protocol (MCP) server, or any AI agent or application acting on your behalf. It adds to, and where inconsistent takes precedence over, the general restrictions above.

What you may do. On a plan that includes programmatic access, you may query the Service automatically, from your own applications and from AI agents you operate, up to the call volume and rate limits of your plan. You may use the results in your internal research, regulatory and business decisions, internal reports, and client deliverables prepared in the ordinary course of your professional services.

Caching and retention. You may cache responses for operational purposes — to avoid repeat calls, to render a report, or to keep a record of what informed a decision. Cached regulatory data becomes stale, so it must not be presented as current beyond 90 days from the dataAsOf value returned with it. You may retain results indefinitely for audit and record-keeping.

Model training. You may not use the Service or its outputs to train, fine-tune, distil, or otherwise develop any machine learning model, embedding, index, or dataset that reproduces or substitutes for the Service. Using an AI agent to query the Service and reason over the results is exactly what the API is for and is permitted; using the Service as a corpus to build something that answers the same questions without us is not.

Resale and redistribution. Data obtained from the Service is licensed to you for your own use and your own clients' engagements. You may not resell, sublicense, syndicate, publish, or otherwise redistribute it as a data product, feed, database, or API, whether free or paid, whether alone or combined with other sources, and whether or not it is transformed or relabelled. Presenting findings to a client in a report is permitted; giving that client, or anyone else, a copy of or standing access to the underlying data is not.

Systematic extraction. You may not use the Service to construct a substantial copy of the database or of any market's registration records, including by iterating identifiers, enumerating result pages, or distributing queries across multiple accounts, keys, or IP addresses to stay under a limit. Plan limits describe the intended shape of use, not a target to work around.

Security. You may not attempt to gain unauthorized access to the Service, other customers' accounts or data, or any underlying infrastructure. This includes probing for vulnerabilities, testing authentication or authorization boundaries, injection of any kind, denial-of-service or load testing, interfering with other customers' use, and using another customer's API key. Keep your API keys secret; you are responsible for all activity under your keys and should revoke a key immediately if it may have been exposed.

We welcome good-faith security research. If you believe you have found a vulnerability, report it to hello@meridiantrace.com before taking any further action, and do not access, alter, or retain data that is not yours. We will not pursue researchers who follow that process.

Attribution. Where you publish findings derived from the Service, please attribute Meridian Trace and state the dataAsOf date of the underlying data.

Enforcement. We monitor API usage for these purposes and may rate-limit, suspend, or terminate keys or accounts that breach this section. Where a breach is inadvertent and promptly corrected we will normally raise it with you first.

3. Subscription tiers and billing

The Service is offered on multiple subscription tiers. The available tiers and their current pricing are described on our pricing page. By subscribing to a paid plan, you authorize us to charge your payment method on the specified billing cycle.

Subscriptions renew automatically unless you cancel before the renewal date. You can manage or cancel your subscription in your account settings. Cancellation takes effect at the end of the current billing period — we do not provide prorated refunds for partial periods, except where required by applicable law.

We reserve the right to change pricing with reasonable notice. If we increase the price of your current subscription, we will notify you by email at least 14 days before the change takes effect.

4. Free tier limits

The Free trial allows up to 24 searches per day at no charge for 7 days. A "search" is counted each time you submit a query to the Service. Search counts reset daily. When the trial period ends, additional searches require a paid subscription.

Free tier users do not have access to CSV export, bulk data features, or API access. These features are available on paid tiers as described on the pricing page.

We reserve the right to modify free tier limits at any time with reasonable notice to registered users.

5. Data accuracy and disclaimer

The registration data in the Service is sourced from official public regulatory databases maintained by BPOM, HSA, MDA, FDA-TH, PMDA, MFDS, NMPA, DAV, FDA (US), EUDAMED, Health Canada, ANVISA, CDSCO, TGA, TFDA, MDCO, FDA-PH, MOHAP/EDE, and their respective authorities. We retrieve this data through available public sources and process it to make it searchable and normalized across markets.

We do not guarantee that the data in the Service is complete, current, or free from errors. Regulatory databases are updated by the relevant authorities on their own schedules, and there may be a lag between changes in the official registry and the data available in the Service. For compliance-critical decisions, always verify against the current official registry directly.

Some data in the Service is derived by Meridian Trace rather than scraped directly from official sources. This includes:

Enriched data layers are the intellectual property of Meridian Trace. The Service clearly indicates which data fields are sourced directly from official registries versus derived by us. You should rely on official sources for regulatory submissions, legal proceedings, or other compliance-critical purposes.

6. Intellectual property

The Service, including its software, design, and the enriched data layers produced by Meridian Trace (OEM inferences, translations, normalizations, company groupings), is owned by or licensed to Meridian Trace and is protected by applicable intellectual property laws.

The underlying registration data sourced from official regulatory databases is public information and is not claimed by us as proprietary. Our indexing, normalization, enrichment, and presentation of that data in the Service is our own work.

You retain ownership of any data you provide to us (such as your account information and any data you upload). You grant us a limited license to use such data to provide the Service to you.

7. Limitation of liability

To the fullest extent permitted by applicable law:

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

Meridian Trace shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including but not limited to: loss of profits, loss of business opportunity, decisions made based on inaccurate or incomplete data in the Service, or regulatory consequences arising from reliance on the Service without verification against official sources.

Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid us in the 12 months immediately preceding the claim, or SGD 100, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

8. Indemnification

You agree to indemnify and hold harmless Meridian Trace, its officers, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Service in violation of these Terms; (b) your violation of any applicable law or regulation; or (c) your infringement of any third-party rights.

9. Account termination

You may terminate your account at any time by contacting us at hello@meridiantrace.com or through your account settings. Upon termination, your access to the Service will cease at the end of your current billing period.

We may suspend or terminate your account immediately, without prior notice, if we determine that you have violated these Terms, are engaged in fraudulent or abusive activity, or where continued access poses a security or legal risk. We will attempt to notify you of any termination by email unless notification is not possible or appropriate in the circumstances.

10. Changes to the Service

We may modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of material changes where practicable. We are not liable to you or any third party for modifications, suspensions, or discontinuation of the Service.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email and by posting the updated Terms on this page with an updated effective date. Your continued use of the Service after such notice constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you should stop using the Service and cancel your subscription.

12. Governing law and disputes

These Terms are governed by applicable law. Any disputes arising from these Terms or your use of the Service that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of competent jurisdiction.

We encourage you to contact us directly before initiating formal proceedings. Most issues can be resolved quickly through direct communication.

13. Miscellaneous

These Terms constitute the entire agreement between you and Meridian Trace regarding the Service and supersede any prior agreements. If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full effect. Our failure to enforce any provision does not constitute a waiver of our right to enforce it in the future.
